Para compreender o homicídio doloso: Em busca de determinantes de sentenças condenatórias

Abstract

Implementing research of mixed methods, I seek to identify determining elements of condemnatory sentences for accused of homicide. The empirical material consists of 154 denouncements offered between December 2004 and December 2005 in Belo Horizonte. The documental analysis allowed the extract of variables that comprised the database for statistical analysis. Nine years after the start of criminal instruction in the trial by jury, the procedural handling of each denouncement was consulted. Of this set, 130 cases were unfiled for documental analysis of the sentences. Legal, contextual, and individual variables made it possible to construct a typology of homicides, and it was feasible to compare two types: "drugs/trafficking" and "daily conflicts". The results show the importance of the denouncement in the moments of decision in the trial by jury and a higher condemnation rate among those accused of drug/trafficking homicides. 1 Professora da Universidade Federal Fluminense, no Departamento de Segurança Pública do Instituto de Estudos Comparados em Administração de Conflitos (DSP/InEAC/UFF).
