LEI DE ACESSO À INFORMAÇÃO: ESTUDO DA TRANSPARÊNCIA PASSIVA E TRANSPARÊNCIA ATIVA NA UNIVERSIDADE FEDERAL DA BAHIA

Abstract

This article analyzes the results of the Law no 12,527/2011 - Law on Access to Information (LAI) implementation, at the Federal University of Bahia, in in its passive and active transparency. Considering the international and national experiences, it was verified that the institution implemented the LAI with a incomplete culture of spontaneous availability of information. In the passive transparency dimension, the findings indicate an incomplete convergence of the institution regarding the fulfillment of the demands under the law. It was not found however, the phenomena of capture of the instruments of access to information by organized economic groups, the occurrence of implicit negatives and the presence of generalized difficulties in the fulfillment of requests. In the active transparency dimension, it was observed that the UFBA presents the mandatory data determined by law. It was noticed, gaps in the architecture of its electronic pages, resulting in obstacles for users to locate information’s. It is concluded that UFBA has made progress in complying with LAI in relation to legal determinations, but faced implementation failures in relation to the dimensions of access to information analyzed.
