Problems of Exemption from Criminal Liability and Imposition of a Court Fine for Committing Crimes against Religious Freedom

Abstract

В статье рассматриваются проблемы освобождения от уголовной ответственности с назначением судебного штрафа (ст. 76.2 УК РФ) за совершение преступлений против религиозной свободы (ст. 148 УК РФ). Особое внимание уделяется применению нормы об указанном основании освобождения от уголовной ответственности в ситуациях, когда по делу отсутствует потерпевший. Авторами определены пределы действия ст. 76.2 УК РФ, приведены примеры ошибочной правоприменительной деятельности в данной области, даны рекомендации по ее оптимизации. The article considers problems of exemption from criminal liability and imposition of a court fine (Article 76.2 of the Criminal Code of the Russian Federation) for committing crimes against religious freedom (Article 148 of the Criminal Code of the Russian Federation). Particular attention is paid to the application of the rule on the specified grounds for exemption from criminal liability in situations where there is no victim in the case. The authors determine limits of Article 76.2 of the Criminal Code of the Russian Federation, present examples of erroneous law enforcement activities in this area, and give recommendations for its optimization.
