Resilienz als Aufgabe des Verwaltungsrechts – Desiderate und Schwierigkeiten eines Forschungsprogramms

Abstract

Triggered by the COVID-19 pandemic, the term "resilience" is becoming a guiding concept in the current debate on administrative law in Germany that asks how the term can contribute to crisis management. Resilience is part of the social state principle guaranteed by the German constitution. Therefore, the state is obliged to address the consequences of a crisis comprehensively. In doing so, the state must focus on preparedness and responsiveness as two essential aspects of resilience.The article suggestshowadministrative law must change so that these essential aspects of the concept of resilience will have a stronger impact on administrative law and crises can be managed better. © 2022 Duncker und Humblot GmbH.
