PROPRIEDADE INTELECTUAL PARA CRIAÇÕES DE INTELIGÊNCIA ARTIFICIAL

Abstract. The AI age is beginning and with it, there are several doubts about the rights regarding what is created by AIs. Issues such as who is legally responsible for AI creation or decision-making tend to become more frequent in the search for rights. The objective of this work is to review existing forms of protection for artifacts created by AI. The methods of research are the collection of information analysis of scientific literature, synthesis, and deduction. It is still unclear how legislators and policy-makers will act towards ever more autonomous machines, perhaps they should consider a model of the public domain for AI creations since the public domain is the road to privatization. Keywords: Artificial Intelligence, Intellectual Property, Legislation. Resumo. A era da IA esta comecando e, com ela, surgem varias duvidas quanto aos direitos referentes ao que e criado por IAs. Questoes como quem e responsavel legalmente por uma criacao ou tomada de decisao de uma IA tendem a ficar frequentes na busca por direitos. O objetivo deste trabalho e realizar uma revisao sobre as formas de protecao existentes para artefatos criados por IA. Os metodos de pesquisa sao a coleta de informacoes analise de literatura cientifica, sintese e deducao. Ainda e incerto como os legisladores e os decisores politicos vao agir em relacao as maquinas cada vez mais autonomas, talvez devam considerar um modelo de dominio publico para criacoes de IAs, pois o dominio publico e o caminho para a privatizacao.
