DISTÚRBIOS CIBERDEMOCRÁTICOS: OS IMPACTOS DAS FAKE NEWS SOB O PRISMA DO DIREITO DIGITAL

The article now in comment, initially, sought to look at the emergence of the network society and the disturbances caused by the phenomenon of over choice, which dialectically presents itself on the one hand as the ability of multiple choices in the network environment fostering democratization information, and otherwise causes cyberdemocratic disturbances like fake news. Then, it deals with disinformation under the prism of Digital Law, therefore, it concludes with the examination of constitutional, civil, criminal, electoral and consumer law interdisciplinary facets. To solve the problem of writing, that is, how to combat and prevent the damage caused by the spread of fake news in the network environment, the study covers an explanatory, qualitative and theoretical transdisciplinary bibliographic methodology. Finally, it is concluded that what must be combated are the cyberdemocratic disturbances propagated by the network society and not democracy.
