Issue of the Comment to Article 93 of the Administrative Offense Code of the Republic of Tajikistan

Domestic violence is a destructive social phenomenon, which is somewhat observed almost in every fourth family. Women, children, aged parents, disabled relatives most often are the victims of such offences. The paper tries to reveal some problems of the comment to Article 93 of the Administrative Offense Code of the Republic of Tajikistan and makes some suggestions to eliminate these problems. The main problem is that the current legislation specifically does not distinguish between the crime and the administrative offense, which belong to domestic violence. Therefore, the author suggests to include certain chapters into the Criminal Code of the Republic of Tajikistan and the Administrative Offense Code of the Republic of Tajikistan, which would list specific crimes and administrative offenses in the sphere of domestic violence since the problem of domestic violence in the Republic of Tajikistan still remains one of the burning issues in the society.
