With the time period determined, the right holder is required to extend the specified period before the validity period ends. In extending the BUR, it is necessary to pay attention to the Regional Spatial Plan that has been determined by the Regional Government where the BUR are located. It will be a separate problem if the Spatial and Regional Planning in the area changes in line with the policies that have been set by the Regional Government, so that the term of the BUR cannot be extended or the period of time can be extended on condition that the holder of the BUR adjusts the building object. by following the Spatial and Regional Layouts that have been determined by the Regional Government. The purpose of this paper is to describe the status and administrative actions of the local government on the BUR which cannot be extended due to changes in the Spatial and Regional Planning. The method used in this research is juridical-empirical law research. Data sources consist of primary and secondary legal materials. 摘要

根据1960年第5号法律《基本农业条例》第35条第1款,建筑使用权是指在非自己的土地上建造和拥有建筑物的权利,最长期限为30年。期限确定后,权利人应当在有效期满前延长规定的期限。在扩大首都圈的过程中,有必要关注首都圈所在地方政府制定的“区域空间规划”。如果根据地方自治团体制定的政策,该地区的“空间及区域规划”发生变化,不能延长土地利用期限,或以土地利用持有人调整建筑对象为条件延长土地利用期限,则另当别论。按照地区政府确定的空间和区域布局。本文的目的是描述由于空间和区域规划的变化而不能扩展的地方政府在城市中心的地位和行政行为。本研究采用的方法是司法实证法研究。数据来源包括一级和二级法律材料。本研究的结论旨在回答由于空间和区域规划的变化而无法扩展的地方政府在城市发展中的地位和行政行为。
