The author analyzes contemporary scientific thoughts on understanding the right to work, an employment contract as a form of realization of the right to work, which become the basis for their own conclusions. The author substantiates the scientific position on the dynamic context of understanding the right to work, which simultaneously takes into account a very powerful sphere of existence and the development of the right to work in realization: to choose the sphere of the future and activities and to specify the right to work through this choice. There is a direct link between the chosen activity and the content of the right to work. it is concluded that the Constitution of Ukraine, based on international normative legal acts, establishes a formula for the right to work with certain unknowns, and the type of professional activity determines these unknowns. 摘要

该文件的目的是将雇佣合同定性为实现工作权利的一种形式,并概述了在乌克兰未来的《劳动法》中以建议的形式将其作为出现劳动关系的法律事实加以解决的前景。作者分析了当代科学对劳动权利的理解思路,将劳动合同作为劳动权利的一种实现形式,成为自己得出结论的基础。作者在理解工作权利的动态背景下证实了这一科学立场,它同时考虑到一个非常强大的生存领域和实现工作权利的发展:选择未来和活动的领域,并通过这种选择来具体规定工作权利。所选择的活动与工作权利的内容之间存在直接联系。结论是,以国际规范性法律行为为基础的《乌克兰宪法》规定了与某些未知事物一起工作的权利的公式,而专业活动的类型决定了这些未知事物。提出了完善劳动立法的建议。
