The Ukrainian Supreme Court in its recent jurisprudence made conclusions on legal aspects of their application, namely: on the place of EU case-law in the Ukrainian legal system, the value of opinions of the Energy Community Secretariat (ECS) as well as the obligation to conduct consultations with the European Commission and the ECS. 摘要

在加入《能源共同体条约》和与欧盟缔结结盟协定后,乌克兰通过了主要法律,实施了欧盟在能源方面的主要法律。它们纳入了“欧盟法律一体化文书”,即欧盟没有要求但包含的条款,以确保欧盟法律在乌克兰得到正确的转换和适用。乌克兰最高法院在其最近的判例中就其适用的法律方面作出了结论,即:欧盟判例法在乌克兰法律体系中的地位、能源共同体秘书处意见的价值以及与欧盟委员会和能源共同体进行协商的义务。虽然接受欧洲机构关于适用欧盟法律的指导是值得赞扬的,但最高法院适用欧盟法律原则的方式,特别是与能源市场运作有关的原则,似乎还有改进的余地。
