The Definition and Scope of Electronic Communications Secret

Summary The concept of telecommunications secret, defined in the Telecommunications Act, has been in use in Polish law for several years. In connection with the entry into force of the European Electronic Communications Code, a draft Act on Electronic Communications was prepared, which includes provisions on the secrecy of electronic communications. The subject of the article will be to analyze whether the proposed regulations meet the requirements of the constitutional principle of the protection of confidentiality of communication and what is their relation to the provisions on the protection of personal data.
