The imposition of administrative sanctions from the Commission do not have permanent legal force, where they opened a space for parties reported to object to the level of the Supreme Court (MA). The process to obtain permanent legal force very long whereas 73% of MA won the Commission's decision. Both to achieve effective enforcement, it is necessary to expand the authority of the Commission, which sanctions the administration carried out by the Commission are final or not opened space object. 摘要

本研究旨在以潘卡西拉理论为基础,重构欧盟委员会在本田与雅马哈卡特尔案中的执法效能。本文首先探讨了商业竞争监督委员会(KPPU)在反垄断案件执法中的有效性。两者都对1999年第5号法关于禁止垄断行为和不正当竞争的条款进行了重构,以提高执法效力。本研究是一种理论性的立法与研究方法。研究表明,委员会的第一次执法没有有效运作。委员会实施的行政制裁不具有永久的法律效力,这为据报向最高法院一级提出反对的各方提供了空间。获得永久法律效力的过程非常漫长,而73%的MA赢得了委员会的决定。要实现两者的有效执行,就必须扩大委员会的权限,其中制裁委员会所执行的行政管理是最终的或不开放的空间对象。为了确保委员会的决定是公平的,那么就需要在委员会内部进行权力分享,以建立内部控制领域。
