摘要

本研究以16世纪英美法系的提单为例,探讨海上货物运输的法律。本研究采用实证研究的方式,将实地获得的证据进行展示,并结合已有的文献资料和理论进行分析。研究的结果是,所研究的每一项国际法规都没有明确描述出口商和进口商的权利和义务。但是,背面的提单合同将出口商和进口商的权利和义务描述为“商人”。研究结果表明,如果提单已经公布,效率是通过原因实现的,没有重量误解,各方遵守适用的立法,不虚假签署,将提单存放在安全的地方以免消失,一致的前提下B/L不被修改,出口商研究货物的重量标准根据船型装运,出口商研究货运代理公司以便管理清关,选择合适的值得信赖的保险公司,为承运人的利益关注偏离成本,使用安全的付款方式,避免交易不安全时产生更多的成本,使用投降B/L模式,避免在装卸港装货时间,检查有效货物的文件,包括B/L是否完整,避免在海关区域扣押货物,进行集装箱检查,避免泄漏,防止分配给能力较差的员工处理货物单据。
