The research approach uses normative juridical, with secondary data sourced from primary legal materials and secondary legal materials from March to July 2020. The data was analysed using content analysis combined with prescriptive analysis. As a result, this research proposes the arrangement of compensation in the Law on Land Procurement for the Development of the Public Interest. 摘要

本研究旨在对2012年第2号《征地开发公益法》对土地出让后改善土地所有者福利的影响进行司法分析。研究的重点是从赔偿评估人、赔偿评估、赔偿确定的审议等方面对赔偿安排进行研究。研究方法采用规范性的法律,辅助数据来源于2020年3月至7月的一级法律材料和二级法律材料。采用内容分析与规范分析相结合的方法对数据进行分析。因此,本研究提出在《土地征用法》中安排补偿,以促进公共利益的发展。这些安排包括《土地采购法》中评估人的实质确定、补偿的价值、确定补偿的审议、补偿的保管(寄售)等,与土地采购的原则和原则不一致,应作为制定规范的依据和指导方针。
