Accordingly, relevant statutes vest original jurisdiction over copyright matters in the Federal High Court3. The Federal High Court Act provides that the Federal High Court should adopt summary trial in all criminal proceedings before it4. Thus, persons accused of criminal infringement of copyright are tried summarily at the Federal High Court. Meanwhile, Section 36(6)(a) and (b) of the Constitution guarantees the right of every person charged with a criminal offence to prompt and detailed information on the nature of the offence against him and the right to be given adequate time and facility for the preparation of his defence. This paper contends that summary trial of persons accused of copyright crimes at the Federal High Court is inconsistent with these constitutionally guaranteed rights to fair hearing. 摘要

版权被列在尼日利亚联邦共和国1999年宪法(经修订)的专属立法清单中。因此,相关法规将版权事务的原始管辖权授予联邦高等法院3。《联邦高等法院法》规定,联邦高等法院在其审理的所有刑事诉讼中应采用即决审判。因此,被控刑事侵犯版权的人在联邦高等法院即审即决。同时,《宪法》第36(6)(a)和(b)条保证每一个被控刑事犯罪的人都有权迅速得到关于对他的犯罪性质的详细资料,并有权得到充分的时间和便利,以便准备辩护。本文认为,在联邦高等法院对被指控犯有版权罪的人进行即决审判与这些宪法保障的公平听证权不一致。这篇论文建议对法律进行修订,使对侵犯版权的审判能够以信息为依据。
