This paper is devoted to an evaluation of the new system in terms of the balance between the concepts of democracy and a fair trial with consideration of the citizen judge procedures and the role of the citizen judges. 摘要

本文分析了2009年日本引入新的非专业审判制度——公民法官制度(Saiban-in Seido)对非专业审判人员参与刑事事务的影响。自二十世纪后期以来,外行审判制度的引入似乎一直在国际运动中使刑事司法制度民主化。本文从民主概念与公平审判概念之间的平衡出发,从公民法官程序和公民法官角色的角度对新制度进行了评价。鉴于日本刑事诉讼程序的封闭性和公民法官制度的保密性,本研究将指出在公民法官制度的实践中阻碍民主价值实现的挑战。
