The current regulations governing simple patents demonstrate monopolistic and individualistic tendencies. This study utilizes a normative juridical research method and employs a statute-based approach to critically analyze the provisions of Law No. 13 of 2016, commonly known as the Patent Law. The research findings indicate that the current regulation fails to adequately support inventors of simple patents. The existing first-to-file registration system, resembling that of regular patents, has resulted in low rates of acquisition and registration for simple patents. Consequently, it can be concluded that the regulation of simple patents under the Patent Law does not favor inventors of such patents. In order to rectify this issue, it is crucial to reformulate the legal protection of simple patent innovations based on the principles of the welfare state. 摘要

本研究的主要重点是考察印尼专利制度内对简单专利创新的法律保护,考虑其实质、结构和法律文化。其目的是倡导重新制定有关知识产权,特别是简单专利的社会和经济利用的法规,以便从福利国家的角度解决它们对公共利益的影响。目前有关简单专利的规定显示出垄断和个人主义倾向。本研究采用规范的法学研究方法,采用基于成文法的方法,对2016年第13号法(俗称专利法)的规定进行批判性分析。研究结果表明,现行法规未能充分支持简单专利的发明人。现有的先申请注册制度与常规专利制度类似,导致简单专利的获得和注册率很低。因此,可以得出结论,《专利法》对简单专利的规定不利于此类专利的发明人。为了纠正这一问题,必须在福利国家原则的基础上重新制定对简单专利创新的法律保护。《专利法》的理想制定应该考虑到发明人群体中普遍存在的规范和价值观,从而有必要重新制定植根于印度尼西亚实质、结构和法律文化的法律保护制度。
