Quo Vadis Mekanisme Pengangkatan Anak oleh Warga Negara Asing di Indonesia Melalui Putusan Pengadilan

Abstract

: Adoption is a means of forming a happy family. Adoption also aims to provide fulfillment of children's rights. Adoption of children can be carried out by Indonesian citizens or foreign nationals. However, they both have different settings. This article aims to describe the mechanism and legal implications of adopting children by foreign nationals in Indonesia through court decisions. This article is derived from normative legal research with a statutory and conceptual approach. The results of this study indicate that the Indonesian government has enacted a number of rules regarding international adoption. Foreign nationals who wish to adopt a child must obtain a court decision. This aims to realize the protection of children from inhumane behavior due to cultural differences and to ensure the fulfillment of children's rights. The legal consequences of adopting a child by a foreign citizen are the obligation to fulfill the child's basic rights, inheritance relationships, and guardianship.
