Metode yang dipergunakan adalah penelitian hukum normatif. Dalam penelitian ini data dianalisis secara kualitatif. Berdasarkan hasil penelitian diketahui bahwa Perlindungan hukum terhadap pemilik tanah pertanian yang berdomisili diluar kecamatan tempat letak tanah berdasarkan Peraturan Pemerintah Nomor 41 Tahun 1964 Tentang Pelaksanaan Pembagian tidak memberikan perlindungan terhadap pemilik tanah, karena di dalam Peraturan Pemerintah tersebut menyebutkan bahwa pemilik tanah pertanian yang berdomisili diluar kecamatan tempat letak tanah wajib memindahkan kepemilikan tanahnya kepada orang lain sesuai ketetuan yang telah ditetapkan. \nAbsentee ownership of agricultural land can occur because of the sale and purchase of land and inheritance. This study aims to find out how legal protection is for agricultural land owners who are domiciled outside the sub-district where the land is located based on government regulation Number 41 of 1964 concerning the Implementation of Land Division, and how ideally is the legal protection for agricultural land owners who are domiciled outside the sub-district where the land is located. The method used is normative legal research. In this study the data were analyzed qualitatively. Abstract
Kepemilikan tanah pertanian secara absentee dapat terjadinya karena adanya jual-beli tanah dan pewarisan. Penelitian ini bertujuan untuk mengetahui bagaimana perlindungan hukum terhadap pemilik tanah pertanian yang berdomisili diluar kecamatan tempat letak tanah berdasarkan peraturan pemerintah Nomor 41 Tahun 1964 Tentang Pelaksanaan Pembagian Tanah, dan bagaimanakah idealnya perlindungan hukum terhadap pemilik tanah pertanian yang berdomisili diluar kecamatan tempat letak tanah. Metode yang dipergunakan adalah penelitian hukum normatif. Dalam penelitian ini data dianalisis secara kualitatif.
