Memurluk Güvencesi ve Ohal Sürecinde Yapılan İhraç İşlemleri Üzerine Bir İnceleme

Abstract

With the establishment of the modern state concept, the civil service became a secure profession. However, it has been observed that practices were violated in different periods. The scope of civil servants’ assurance is not unlimited. Civil servants are obliged to act in accordance with the Constitution and laws. In this study, the practices that cause the dismissal of the civil servants in the Republic period were examined. During the state of emergency, exclusions were made by administrative acts and decrees having the force of laws. Those excluded by administrative acts can go directly to administrative courts. Those whose name is added to the list of decrees having the force of laws can go to the Ankara administrative courts following the mandatory administrative application. In this study, the legal nature and control ways of these transactions are examined.
