أحکام الکتابة والشهادة والإملال الواردة فی آیة الدّین وأثرها فی استقرار المجتمع وأمنه (دراسة فقهیة مقاصدیة)

Abstract

تناولت هذه الدراسة الأحکام الفقهیة الواردة فی آیة الدین وذلک من خلال تتبعها واستقرائها من المصادر الشرعیة المختلفة، حیث بینت الدراسة أهمیة الدین وتوثیقه وحکمة مشروعیته وأرکانه وأسباب کتابته، وأهمیة الوفاء به والإشهاد علیه وإملاله، کما تناولت الدراسة الأحکام الفقهیة المتعلقة بذلک وأثرها على امن واستقرار المجتمع وفق مقاصدها الشرعیة. واعتمد الباحث فی دراسته على المنهجین الاستقرائی والتحلیلی لبیان ذلک، وتوصلت الدراسة إلى حکم إباحة الدین ووجوب کتابته وتوثیقه والإشهاد علیه وإملاله عند المقدرة على ذلک. وخلصت الدراسة إلى أن الالتزام بالأحکام الشرعیة المتعلقة بالدین یؤدی إلى حفظ مقصد ضروری من مقاصد الشریعة وهو حفظ المال کما یؤدی إلى استقرار المجتمع وامنه، وبعض النتائج الأخرى. الکلمات المفتاحیة:الدین، الاستقرار، الأمن، ا الإشهاد، الإملال.                 The impact of the provisions of the writing، testimony and the dictum contained in the verse of the indebtedness on the stability and security of society، a study of doctrinal jurisprudence. Jurisprudential provisions related to this and their impact on the security and stability of society according to their legitimate purposes. In this study، the researcher relied on the inductive and analytical methods to explain this، and the study reached the rule of permitting the indebtedness and the necessity of writing it، documenting it، and being committed to it. The study concluded that adherence to indebtedness rulings leads to the preservation of a necessary purpose of the purposes of the law، which is the preservation of money and leads to the stability of society and security and some other results.
