Considering the historical and socioeconomic importance of the activity for the subsistence of many artisanal fishermen, there is a need to order the activity. In this context, the objective of this work was to propose guidelines for the ordering of fishing pens on the Brazilian coast, considering the installation, operation and deactivation phases. Currently, it is possible to observe traps without adequate signage, in areas held by the owners, even practicing the commercialization of the place without any documentation issued by regulatory bodies. Therefore, the installation must take place from the request for the assignment of public space by the Union for fishing purposes through a free declaratory act, online, with MAPA, under the supervision of an area technician. Subsequently, the environmental agency and the Brazilian Navy must be consulted about a 20-year authorization, renewable for another 20 years, granted by the SPU, based on Decree 10.576/2020 directed at aquaculture. In the operation and deactivation stage, the most important aspect is the inspection by the environmental agencies regarding construction issues, such as geographic location, size of structures, materials used in making, selectivity and signaling of the trap, as well as the removal of the art of fishing.
