عِلـمُ الفقـهِ المقــارنِ ودَوْرُهُ فی ترسیخِ القیمِ المجتمعیةِ

Abstract

إن أشرف العلوم مطلقا هو علم التوحید؛ إذ یتصل معلومه بالرب - جل جلاله -  وشرف العلم بشرف المعلوم، ویلیه فی الرتبة علم الفقه فی الدین وهو معرفة الأحکام الشرعیة العملیة وقد وسمه الفقهاء الأوائل بعلم الحلال والحرام،  وعلم الفقه المقارن إنما هو علم الفقه وزیادة؛ من حیث عرض النتاج الفقهی للمجتهدین وتحقیقه وتبیین قویه من ضعیفه، وترجیح ما هو أقرب زلفی إلى دلالات النصوص ومقاصد الشریعة وغایاتها.  وقد وقع اختیاری للمشارکة ببحث – حسب تخصصی-  فی هذا المؤتمر القیم بهذا الموضوع لعدة أسباب أجملها فیما یلی: ·        ضرورة تسلیط الضوء على الأهمیة القصوى لعلم الفقه المقارن فی إصلاح المجتمعات الإسلامیة بترسیخ القیم الراقیة والمثل الفاضلة، وبیان رحابة الاجتهاد الفقهی لعلماء الشریعة. ·        نفی الزیف والدخل عن مقاصد هذا العلم الجلیل وغایاته التی وضعه العلماء لأجلها؛ حتى لا یتخذه أهل الأهواء وسیلة یتحلل بها من شرف التکالیف الشرعیة، وذریعة إلى اتباع شهوات النفوس الخفیة. حداثة هذا الموضوع؛ فهو یمثل جانبا تنظیریا یصحبه تطبیق عملی فی خدمة هذا العلم من جهة قیمیة، فلم أقف على بحث یتناول هذه الآثار الجلیلة لعلم الفقه المقارن فی مجال ترسیخ القیم المجتمعیة. وقد استقصیت أهم القیم المجتمعیة التی یرسخها علم الفقه المقارن من خلال الخطوات العملیة المتبعة فی منهجه البحثی.   The Science of Comparative Jurisprudence and its Role in Establishing Societal Values By: Ahmed Sedqi Abdel-Monem Abdel-Hameed Lecturer in Comparative Jurisprudence Faculty of Islamic Law in Cairo       The most honorable science is that of monotheism since it is closely related to the Almighty God. The honor of this science is bestowed on the learners. Then comes the science of jurisprudence since it entails knowledge of the legitimate judgments and the early jurists identified it as the science of lawful and unlawful. Comparative jurisprudence is much more than jurisprudence since it displays the jurisprudent output of the discretionary by examining it to show the points of strengths and weaknesses, and paying tribute to the closest of them to achieve the purposes of jurisprudence. The researcher is keen on taking part in this conference by selecting the topic of this research due to the following reasons: There is a necessity to highlight the crucial importance of comparative jurisprudence to reform Islamic societies by establishing lofty ideals and values through the discretionary efforts of the jurists. The need to take away falsehood and untrue ideas from the purposes of this honorable science as established by scholars so that it would not be utilized by the moody people as a means to liberate them from the restrictions of jurisprudence then they can follow their whimsical desires. The uniqueness of this topic stems from the theoretical aspect which is followed by another practical aspect designed to serve the set of values. The research has traced the most societal values established by comparative jurisprudence through the practical steps followed in the approach of this research.
