The primary legal materials used in this writing are the 1945 Constitution of the Republic of Indonesia, Law Number 5 of 1960 concerning Basic Agrarian Regulations, Government Regulation Number 24 of 1997 concerning Land Registration, and Government Regulation of the Republic of Indonesia Number 18 of 2021 concerning Management Rights, Land Rights, Flats Units, and Land Registration. As for secondary legal materials in the form of publications on law including text books, legal dictionaries, legal journals, and comments on court decisions. The tertiary legal materials used in this research are the Big Indonesian Dictionary and the Legal Dictionary. The results of the research show that the legal consequences of transferring rights due to the sale and purchase of land that has not been registered are legally valid if the transfer of land rights is due to the sale and purchase of land that has not been registered. the registration has met the material requirements for sale and purchase, namely \"bright\" and \"Cash\". Abstract

This article aims to discuss the legal consequences of buying and selling land rights that have not been registered and legal protection for buying and selling land rights that have not been registered. 未登记的土地买卖权利的法律保护
本文旨在探讨买卖未登记土地权利的法律后果以及买卖未登记土地权利的法律保护。本文采用规范的法学研究方法。本研究的性质是描述性分析。本文使用的主要法律材料是1945年印度尼西亚共和国宪法、1960年关于基本农业条例的第5号法律、1997年关于土地登记的第24号政府条例和2021年关于管理权、土地权、单位和土地登记的第18号印度尼西亚共和国政府条例。至于法律出版物形式的二手法律资料,包括教科书、法律词典、法律期刊和法院判决评论。本研究使用的三级法律资料是《大印尼语词典》和《法律词典》。研究结果表明,如果土地权利的转让是由于买卖未登记的土地而发生的,则因买卖未登记的土地而发生的权利转让的法律后果具有法律效力。登记已满足买卖的物质要求,即“光明”和“现金”。对因买卖未登记的土地而获得土地权利的购买者的法律保护,如果获得土地权利的人是出于善意,仍然会得到法律保护,即采取压制性法律保护的形式,即更多地针对解决争端的努力的法律保护,例如在法庭上解决争端。
