Abstract

This article has the goal to discuss the access to justice and its current and historical development, based on literature review of some important titles, which aims to bring the consolidation of this institute as a right that integrates both constitutional and fundamental rights, and it also demonstrates that it belongs to the minimum existential and for the exercise of the ‘human’s dignity’, since this right is repeatedly used in demands from which the judiciary is addressed to correct existing social problems, and the gaps left by the legislative and the executive’s inertia.
