The reasons are as follows: (a) surrounding SOEs is not only trade-related, but also competition-related; (b) the existing SOE disciplines have defects when it comes to dealing with competition distortion effects; and (c) characteristics of competition policy make it easier to reach a “maximum common divisor” among all parties. Accordingly, competition policy needs to be redefined and pursued from an international and domestic level. Abstract

With the growing concern of the international community about the negative spillover effects of SOEs on trade, reaching a consensus among different stakeholders has become increasingly urgent. This paper argues that strengthening a redefined competition policy is a feasible alternative, or at least a complementary option to the existing trade framework. 随着国际社会越来越关注国有企业对贸易的负面溢出效应,在不同利益相关者之间达成共识变得越来越紧迫。本文认为,加强重新定义的竞争政策是一种可行的替代方案,或者至少是对现有贸易框架的补充方案。究其原因,主要有以下几个方面:(a)国有企业的周边不仅与贸易有关,而且与竞争有关;(b) 现有国有企业规则在处理竞争扭曲效应方面存在缺陷;(c)竞争政策的特点使各方更容易达成“最大公约数”。因此,需要从国际和国内两个层面重新界定和推行竞争政策。要强化竞争政策在中国的基础地位,将其纳入国有企业改革措施,推进公平竞争审查制度的实施,推进竞争中性制度的建设。
