Abstract
This paper deals with a brief compendium of relevant Mexican court precedence on the occasion of the Civil law legal fiction so-called Positive prescription, that is, operating with an element of bona fide, which is also known as usucapionis. Contrasting the binding interpretation of the judiciary (which it must be applied by the bar and it obliges observance from the legal practitioner) with the historical and juridical literature available in the sources of the roman law.
