Abstract

The promulgation of Chinese Charity Law in March 2016 was expected to break the long-term monopoly of governmental charities in public fundraising in China. However, governments’ regulating practices on fundraising seem to be still quite ambivalent during the post-legislation era, indicating endogenous contradictions of the Charity Law. 规范中国公募:《慈善法》及其前身
2016年3月颁布的《慈善法》有望打破政府慈善机构长期垄断中国公募的局面。然而,在后立法时代,政府对募捐的监管实践似乎仍然相当矛盾,这表明了《慈善法》的内生矛盾。为了探究中国慈善法关于公募监管的立法逻辑,本文运用国家-社会关系的分析框架,对改革开放以来中国所有涉及公募监管问题的相关法律和政策进行了历史考察。揭示了中国政府对公民募捐的“控制思维”一直主导着这一领域,而最近国家控制的放松是由自下而上的社会动力所驱动的。本文认为,在国家控制思维的持续影响下,中国慈善法对公民募捐开放空间的制度调整往往是较为被动和内在矛盾的,导致了法律在实践中的有效性与局限性并存。
