Penolakan pendaftaran peralihan hak melalui lelang oleh Badan Pertanahan Nasional (BPN) dengan alasan masih adanya sengketa atas tanah sering menimbulkan gugatan dari pembeli lelang eksekusi Hak Tanggungan di Pengadilan Negeri maupun Pengadilan Tata Usaha Negara (PTUN) terhadap BPN. Metode penulisan ini dalam penulisan ini dengan menggunakan jenis penelitiannya adalah penelitian hukum doktrinal ( doctrinal ) atau normatif, yang mengkaji hukum sebagai norma. Hasil pembahasan menegaskan bahwa Peraturan Menteri Agraria dan Tata Ruang Nomor 13 Tahun 2017 telah memberikan perlindungan hukum bagi pembeli lelang untuk melakukan permohonan peralihan hak atas tanah yang dibeli walaupun sedang terdapat sengketa tetapi juga peraturan ini dianggap menderogasi sebagian hak dari pembeli lelang. Kata kunci: Lelang, Hak Tanggungan, Perlindungan Hukum. Abstract
ABSTRAK Hak Tanggungan memberikan hak bagi Kreditur untuk menjual objek Hak Tanggungan atas kekuasaan sendiri melalui pelelangan umum serta mengambil pelunasan piutangnya dari hasil penjualan tersebut terhadap debitor yang telah wanprestasi yang dikenal sebagai Lelang Eksekusi Hak Tanggungan. Penolakan pendaftaran peralihan hak melalui lelang oleh Badan Pertanahan Nasional (BPN) dengan alasan masih adanya sengketa atas tanah sering menimbulkan gugatan dari pembeli lelang eksekusi Hak Tanggungan di Pengadilan Negeri maupun Pengadilan Tata Usaha Negara (PTUN) terhadap BPN.
