However, none of the countries has avoided errors in regulating upskirting. Based on their experiences, the following proposals de lege ferenda are formulated. It is necessary to introduce a new type of a prohibited act penalising recording and dissemination of an image of genitals, buttocks and underwear covering those body parts if they are hidden from third persons’ eyesight. However, the parts of body protected by this provision should not include breasts. The requirement of a perpetrator’s special motive laid down in the English regulation is disapproved.
