Abstract

In the field of study of family law, the main achievements had until pre-sent times, been carried out historically in Civil law jurisdictions as part of the work by jurists who specialize in its Private law branch, the same method of categories used in the analysis of private law has been consistently borrowed for this endeavor, however, with the taking several of its closely related issues to constitutional rank, it has since become a necessity to rethink the approaches from which it has been commonly dealt with in order to commune with the current state of the art of Human Rights doctrine.
