It is proved that this problem is closely related to another one – the problem of defining a certain legal concepts, substantiates a significant expansion of the scope of judicial discretion in determining the grounds for cassation appeal in a particular case.The article considers the possibility of referring to the decisions of the European Court of Human Rights as the sources of civil procedural law of Ukraine. Abstract

New rules for transferring the case from one court to another are being investigated, the conclusion on expanding the competence of the court on this issue is substantiated. 乌克兰民事诉讼立法改革及其实施问题
正在调查将案件从一个法院移交给另一个法院的新规则,关于扩大法院在这一问题上的权限的结论得到了证实。审议了对索赔内容最有问题的要求,这些要求没有法律和组织机制。特别注意到执行“最高上诉过滤器”的问题,自从主要改革加强这些过滤器以来,这些过滤器又发生了一些变化。事实证明,这一问题与另一个问题密切相关——界定某些法律概念的问题,证明了在确定特定案件的最高上诉理由时,司法自由裁量权的范围大大扩大。该条考虑了将欧洲人权法院的裁决作为乌克兰民事诉讼法来源的可能性。戒严令下的司法问题得到了单独的考虑。结论是,评估司法改革的有效性涉及科学和实践的批判性考虑,对执法实践的总结和分析将为最终评估改革的质量提供依据。
