Abstract

In the Guidelines of the State Council General Office on Government Procurement of Services from the Private and Non-governmental Sectors, “public service provider for the government” is broadly defined; it is stated that npos, businesses, and industry organizations have equal opportunity to be public service providers. 社会组织作为服务提供者被政府承包的条件探析——基于地方政府文件分析的研究
《国务院办公厅关于政府向私营和社会组织采购服务的指导意见》对“政府公共服务提供者”的定义较为宽泛;报告指出,非营利组织、企业和行业组织作为公共服务提供者的机会是平等的。比较各地对非营利组织公共服务提供者资格的要求,可以发现其资格要求主要集中在服务提供者资格、成立时间、组织管理、人力资源、财务管理、专业资格、年检、评价、荣誉等方面。总的来说,这些要求并不苛刻;公共服务的质量也通过制度设计和创新得到保证。地方政府对非营利组织作为公共服务提供者的资格要求宽松,表明社会治理体系将呈现多样性,也反映了政府支持和发展非营利组织的意愿。然而,地方政策也存在一些问题,如:1)政府的自由裁量权过大;2)资格要求不利于基层组织的发展;(三)未明确公共服务提供者资格标准;4)相关法律法规缺乏权威性。因此,有必要使政府采购公共服务法治化,为实施最权威的政策提供持续的理论和制度支持。
