Abstract

Abstract Whether the Numerus Clausus Principle is adhered to in IP Rights (IPRs) Law determines whether judges have the discretion to explain the rights that have not been legislated in a case. 知识产权法是否坚持法定权利原则,决定了法官对案件中未立法规定的权利是否具有解释自由裁量权。法益是权利的上级概念,《民法典》第一百二十六条规定的“法律规定的其他权益”是指不同类型的法益。法官在案件中行使自由裁量权给予救济的法律利益是《民法典》第126条中的“利益”,没有上升为法律权利。个别知识产权法中与法定权利原则相冲突的灵活表述应当在今后予以修订。法定权利原则还要求法官在判断和推理时谨慎运用开放概念,并有区别地保护法律利益。
