摘要

环境治理的动力机制是问责制。中国中央政府采取环境保护督察的路径,实行“党政共担责任”、“一职双责”、“严问责”,抓住了环境治理问题的本质,但环境督察对环境治理只能起到短期的作用,不能取代已经建立的长期的法律制度。必须避免只看环境检查的极端情况。环境治理要自觉回归长效法律机制,以问责制为关键支柱,强化法律问责与政治问责并重,以环保考核为驱动机制,发挥环保督查制度的政治优势,督促环境治理主体依法履职,构建环境治理长效机制。
