The reconstruction of the transfer of land rights refers to article 3d of Government Regulation Number 41 of 1964 concerning the Implementation of Land Division and Compensation Providers which states that it is prohibited to carry out all forms of transferring new rights to agricultural land which results in the landowner concerned owning a plot of land outside the Regency where he resides. However, this provision actually hinders the current transfer of agricultural land rights. 摘要

本研究的目的是从概念上考察土地所有权的转让和土地所有权转让的重建如何符合正义的价值。重建土地权利转让是指1964年关于实施土地分割和提供补偿的第41号政府条例第3条,该条例规定,禁止对农业土地进行一切形式的新权利转让,这将导致有关土地所有人在其居住的摄政以外拥有一块土地。然而,这一规定实际上阻碍了当前农业土地权利的流转。这是因为其中一方没有获得他们的权利,即不能在买卖契约中约束买卖,不能自动进行土地登记以获得证明其土地权利的证书,因此,关于实施土地分割和补偿的1964年第41号政府条例第3d条的规定必须立即修订,因为它们不符合正义的价值。
