One of the backgrounds of the birth of this Act was the pressure of the IMF (International Monetary Fund) as part of Letter of Intent (LOI) at that time. As a result, the embodiment of Islamic values in the drafting of the Law has not been carried out at all. This can be seen from the provisions of the exception of Article 50 especially exceptions to small businessman. This research is juridical normative research by qualitative analytical method, and the data that the author use is secondary data consisting of primary and secondary legal materials. Ideal law is a law that is created in accordance with the noble values of its people, and should be accommodating the religious values embraced by the people. 摘要

印度尼西亚商业竞争法载于关于禁止垄断行为和不正当商业竞争的1999年第5号法令。该法案诞生的背景之一是当时国际货币基金组织(IMF)作为意向书(LOI)一部分的压力。因此,在法律的起草过程中根本没有体现伊斯兰价值观。这可以从第50条的例外规定,特别是对小商人的例外规定中看出。本研究采用定性分析的方法进行法律规范研究,作者使用的数据是由一手法律资料和第二手法律资料组成的二手数据。理想的法律是根据人民的崇高价值观创造的法律,应该容纳人民所信奉的宗教价值观。有必要通过纳入伊斯兰价值观来更新印度尼西亚商业竞争法,以实现反映虔诚价值观的印度尼西亚商业竞争法,同时可以反映潘卡西拉经济体系的价值观。
