The research confirmed that the addition of Article 43 paragraph (1) made by the Constitutional Court through Decision No. 46/PUU-VIII/2010 is not only limited to the right to protection but has a very broad meaning that also includes illegitimate children born to Indonesian Women Workers. In accordance with the principle of equality before the law, the law must provide fair protection and legal certainty. The findings of this study revealed that illegitimate children of migrant workers can obtain constitutional rights as Indonesian citizens adhering to the principles of the rule of law. 摘要

有些人认为婚外儿童在日常生活中的地位很低,另一方面,在福利和公民权利方面仍然受到限制。本研究的重点是宪法法院关于印尼女工私生子的第46/ PUU-VIII /2010号决定的执行情况。研究证实,宪法法院通过第46/PUU-VIII/2010号决定所增加的第43条第(1)款不仅限于受保护权,而且具有非常广泛的含义,也包括印度尼西亚女工所生的私生子。根据法律面前人人平等的原则,法律必须提供公平保护和法律确定性。本研究的结果表明,在坚持法治原则的前提下,外来务工人员的私生子可以作为印尼公民获得宪法权利。因此,宪法法院的判决不仅影响到子女的继承权,而且对农民工所生的非婚生子女的谋生权、监护权、获得生父抚养权等保障和保护也具有启示意义。
