摘要

. 作者主要分析了现实劳动法律关系中最相关的问题:“劳动关系”或“劳动法律关系”等术语(概念)的理论有效性;“实际劳动法律关系”与“实际劳动法律关系的调节者”的比例;实际劳动法律关系的规制类型。该研究得出以下结论。第一:“劳动法律关系”一词(概念)在理论上更为科学合理。第二,实际劳动法律关系的主体是实际劳动法律关系的调节主体。第三,客观上存在法律规制者和个人规制者,两者是实际劳动法律关系的成对范畴。
