Thus, this paper examines the implementation o f the extraterritoriality principle to enable the KPPU and Indonesian courts to exercise jurisdiction over foreign business actors who violate Indonesia's competition law from abroad. This paper employs a comparative approach to analyze the development of the extraterritoriality principle in the US's, EU's, Singapore's, and Malaysia's competition laws. 摘要

东盟经济共同体所带来的区域经济一体化不仅将为其成员国提供无限的经济增长机会,也将面临前所未有的挑战。一个更加互联的区域经济的需求将要求印尼政府作为印尼市场竞争进程的守护者,保护其免受境内外发生的反竞争行为的影响。然而,由于印度尼西亚现行竞争法没有赋予KPPU调查、起诉或惩罚印尼境外商业行为者违法行为的管辖权,因此存在重大差距。因此,本文审查了域外原则的实施情况,以使KPPU和印度尼西亚法院能够对从国外违反印度尼西亚竞争法的外国商业行为者行使管辖权。本文采用比较法分析了域外原则在美国、欧盟、新加坡和马来西亚竞争法中的发展。本文最后确定了应如何实施治外法权原则,以加强印度尼西亚的竞争执法。
