Based on a review of academic journal articles and legal documents, this paper highlights the evolution of community correction programs for juvenile offenders in China. Reflecting on its development over the past two decades, the existing community correction programs in China are not restorative in facilitating an offender’s effective reintegration into the community. This paper aims to address the existing gap by examining the historical roots and characteristics of Chinese juvenile community corrections and analyzing how restorative justice can be incorporated into the youth rehabilitation system. In this regard, this paper advocates for a restorative juvenile community correction model that motivates social capital and actively engages all concerned parties in meeting various correctional goals of victim reparation, accountability taking, capacity building, and maintaining community safety. With the momentum of the recent criminal justice reform alongside the continued open-door policy in China, it is hoped that the Chinese government may be more willing to include restorative ideas for offender reintegration in the future. 摘要

长期以来,以社区为基础的治疗一直是大多数西方司法管辖区刑事司法系统的一个主要组成部分;然而,在中国并非如此。本文在回顾相关学术论文和法律文献的基础上,回顾了中国未成年犯社区矫正项目的发展历程。反思过去二十年的发展,中国现有的社区矫正项目在促进罪犯有效融入社会方面并没有起到恢复性的作用。本文旨在通过考察我国青少年社区矫正的历史根源和特点,并分析如何将恢复性司法纳入青少年康复体系,来弥补这一空白。因此,本文主张建立一种恢复性的青少年社区矫正模式,调动社会资本,积极调动各方参与,以实现受害者赔偿、责任追究、能力建设和维护社区安全等多种矫正目标。随着最近刑事司法改革的势头以及中国持续的门户开放政策,希望中国政府在未来可能更愿意纳入罪犯重返社会的恢复性思想。随着恢复性司法的应用越来越频繁,我们相信有效的干预模式可以在未来几年付诸实践。
