Interaction between territorial bodies of the Federal Penitentiary Service of Russia and the Ministry of Internal Affairs of Russia to prevent recidivism among those sentenced to punishment without isolation from society

Введение: в статье раскрываются правовые и практические аспекты организации взаимодействия сотрудников уголовно-исполнительных инспекций и территориальных подразделений органов внутренних дел в сфере профилактики повторной преступности среди осужденных к наказаниям без изоляции от общества. Цель исследования состоит в разработке предложений по внесению изменений и дополнений в совместные приказы по организации взаимодействия сотрудников уголовно-исполнительных инспекций и территориальных подразделений органов внутренних дел для повышения эффективности предупреждения рецедива преступности среди подучетных лиц. Методы: анализ результатов теоретических исследований по теме, контент-анализ, толкование правовых норм, сравнительно-право- вой, анализ статистических данных. По результатам анализа сформулированы предложения по внесению изменений и дополнений в региональные совместные приказы по взаимодействию сотрудников уголовно-исполнительных инспекций и органов внутренних дел в сфере организации работы с подразделениями по делам несовершеннолетних, участковых уполномоченных полиции, а также по организации розыска лиц, скрывшихся от сотрудников уголовно-исполнительных инспекций. Выводы: организация взаимодействия между сотрудниками уголовно-исполнительных инспекций и органов внутренних дел играет важную роль в профилактике повторной преступности среди осужденных к наказаниям без изоляции от общества. В настоящее время в Российской Федерации действует совместный приказ Минюста России и МВД России от 04.10.2012 № 190/912 «Об утверждении Регламента взаимодействия ФСИН России и МВД России по предупреждению совершения лицами, состоящими на учете уголовно-исполнительных инспекций, преступлений и других правонарушений». Кроме того, в ряде территориальных органов действуют региональные приказы по организации взаимодействия вышеуказанных структурных подразделений на районном уровне. Передовой опыт наиболее эффективной работы по предупреждению повторных преступлений лиц, осужденных к наказаниям без изоляции от общества, необходимо изучать, внедрять и использовать. Introduction: the article reveals legal and practical aspects of organizing interaction between employees of penal inspections and territorial divisions of internal affairs bodies. Purpose: to develop proposals for amending joint decrees on the organization of interaction between employees of penal inspections and territorial divisions of the department of internal affairs in order to boost effectiveness of preventing recidivism among persons registered with penal inspections. Methods: analysis of the results of theoretical research on the topic, content analysis, interpretation of legal norms, comparative law, analysis of statistical data. Based on the results of the analysis, the author proposes amendments and additions to regional joint decrees on the interaction between employees of penal inspections and internal affairs bodies in the field of organizing work with juvenile affairs units, district police officers, as well as on searching for persons who have escaped from employees of penal inspections. Conclusions: the organization of interaction between employees of penal inspections and internal affairs bodies plays an important role in the prevention of recidivism among those sentenced to punishment without isolation of society. Currently, in the Russian Federation the joint Decree of the Ministry of Justice of Russia and the Ministry of Internal Affairs of Russia No. 190/912 of October 4, 2012 “On approval of the Rules of interaction between the Federal Penitentiary Service of Russia and the Ministry of Internal Affairs of Russia on the prevention of crimes and other offenses committed by persons registered with penal inspections” (hereinafter: Interaction Rules) is in force. In addition, a number of territorial bodies have regional decrees on the organization of interaction of the above-mentioned structural units at the district level. The most effective practices on the prevention of recidivism among persons sentenced to punishment without isolation from society should be studied, implemented and used.
