This study employs a normative juridical method to analyse legal norms and principles. The approaches used include a statutory approach, a comparative law approach, and a case approach. This study reveals that the regulations concerning the prohibition of monopolistic practices and unfair business competition have not explicitly regulated extraterritorial norms in Indonesia. However, the Business Competition Supervisory Commission makes legal breakthroughs by applying the extraterritorial principle to resolve the involvement of foreign business actors and impose penalties on them. 摘要

以效力原则为基础的竞争法域外管辖权的适用问题一直存在争议。本文探讨了域外管辖权在印尼竞争法中的适用。印度尼西亚的竞争法适用于对商业和经济领域产生必要影响的任何串通或滥用行为,无论公司的国籍或地理位置或发生行为的地点如何。本研究采用规范法学方法分析法律规范与原则。所使用的方法包括成文法方法、比较法方法和案例方法。这项研究表明,关于禁止垄断行为和不正当商业竞争的规定没有明确规定印度尼西亚的治外法权规范。然而,商业竞争监督委员会在法律上有所突破,运用治外法权原则解决外国商业行为者的参与并对其进行处罚。本文认为,印度尼西亚明显需要修改其竞争法,并加强与其他国家的合作,以执行竞争法。
