Chemical castration formulated in Article 81 Paragraph (7) is not following the values of Pancasila, especially the first principle, namely belief in One and Only God, and the second principle, just and civilized humanity. Substantially, the castration penalty causes an individual to lose the right to continue the lineage and fulfill basic needs as guaranteed in Article 28B paragraph (1) of the 1945 Constitution. 摘要

在印度尼西亚,针对儿童的性暴力发生率非常惊人。儿童性暴力的施暴者通常是与受害者关系密切的成年人,包括家庭成员和邻居。性暴力是对人权的侵犯。性暴力剥夺了受害者的安全和保护、身体和精神繁荣的权利、不受贬低人的尊严的酷刑或待遇的权利,以及生存的权利。2016年第17号法律规定的化学阉割是一种不属于印度尼西亚刑法政策的惩罚形式,印度尼西亚的刑法政策基于潘卡西拉和1945年宪法。第八十一条第(七)项规定的化学阉割不符合潘卡西拉的价值观,特别是第一原则,即信仰唯一的上帝,第二原则,即公正和文明的人类。实质上,阉割惩罚使个人丧失延续血统和满足1945年《宪法》第28B条第(1)款所保障的基本需要的权利。1999年关于人权的第39号法第10条第(1)款也有同样的规定。
