The research method used is a normative legal research method with approach legislation. The results illustrate that the juridical implication of the Job Creation Act in the mineral and coal mining sector is that in its decision the Constitutional Court stated that the Job Creation Act was still valid as long as the law-makers made improvements in the procedures for establishing Job Creation Law. In this case, the Constitutional Court has given two years for the legislators to revise the procedure for the formation of the Job Creation Law since the decision was pronounced. If no improvements are made, the Law can be declared unconstitutional permanently. 摘要

本研究旨在分析和审查第91/PUU XVII/2020号宪法法院关于矿产和煤炭开采部门创造就业法的决定的法律含义。本文采用的研究方法是一种接近立法的规范性法律研究方法。结果表明,《创造就业机会法》在矿物和煤炭开采部门的法律含义是,宪法法院在其判决中指出,只要立法者改进制定《创造就业机会法》的程序,《创造就业机会法》仍然有效。因此,宪法裁判所在做出决定后,给了议员们2年时间修改《创造就业机会法》的制定程序。如果不作出改进,该法律将被永久宣布为违宪。因此,如果关于创造就业机会的2020年第11号法律违宪,即永久取消煤炭激励机会,那么由于第128A条的煤炭利用目标,必须确实取消煤炭激励机会。这将增加煤炭在国家能源结构中的比例,总体上将系统地与气候适应和减缓目标和计划重叠,以及《创造就业法案》中的条款也被采矿和肮脏能源企业的利益所渗透。
