Forced labor: problematic aspects of punishment implementation

Abstract

В статье рассмотрены проблемные аспекты реализации принудительных работ как вида уголовного наказания. Актуальность анализируемых в статье вопросов обусловлена положениями Концепции развития уголовно-исполнительной системы Российской Федерации на период до 2030 года в соответствии с которыми развитие сети исправительных центров, обеспечивающих исполнение наказаний в виде принудительных работ, отнесено к числу стоящих перед УИС вызовов и обозначено в качестве одного из основных направлений ее развития. Решение данных проблем позволит принудительным работам занять достойное место в общей системе наказаний не только де-юре, но и де-факто. The article discusses problematic aspects of implementing forced labor as a type of criminal punishment. The issues under analysis are relevant, since according to the provisions of the Concept for the development of the penal system of the Russian Federation for the period up to 2030, the promotion of a network of correctional centers to ensure execution of punishments in the form of forced labor is attributed to the challenges the penal system has to address and is determined as one of key directions of its development. Solving these problems will help forced labor to take its rightful place in the general system of punishments not only de jure, but also de facto.
