A Comparative and Scholarly Analysis of Four Schools of Islamic Jurisprudence about the Islamic Law of Khula

Abstract

System of Khula in IslamiShariah is an essential part of family laws. It provides permission to a married couple for the cessation of wedlock with peace so that their mutual disagreements could not make the life oppressive for one of the partner. Islam is a religion of peace and bars high - handedness. No doubt system of Khula in Islamishariah is a great boon. Islam not only confers upon husband as a head of family the authority of unilateral decision of separation in the form of divorce but also posits law of Khula for separation. All the schools of fiqh have presented detailed interpretation and exposition of the rules and regulations of the system of Khula.
