Abstract
The article investigates the background, contents, methods of interpretation as well as consequences of the newly adopted Article 4462 of the Polish Civil Code. The authors conduct a critical analysis of the provision by indicating numerous doubts that have not been resolved by the legislator when introducing it to the Civil Code.
