Forms and methods of protection of the constitutional rights of citizens by diplomatic missions in the context of the coronavirus pandemic

Abstract

В статье рассмотрены отдельные аспекты деятельности дипломатических представительств по защите конституционных прав граждан Российской Федерации, находящихся на территории иностранных государств, в условиях пандемии коронавирусной инфекции. Определено, что российская нормативно-правовая база прошла этап серьезной модернизации в рассматриваемый период, временно отказавшись от использования диспозитивных начал в пользу императивного метода правового регулирования. Для анализа деятельности дипломатических представительств в условиях коронавирусной инфекции рекомендовано использовать термин «оказание помощи». Авторами обоснована позиция о необходимости пересмотра сущности дипломатической защиты с учетом опыта работы дипломатов в период пандемии. The article considers certain aspects of the activities of diplomatic missions to protect the constitutional rights of citizens of the Russian Federation located on the territory of foreign states in the conditions of the coronavirus pandemic. It is determined that the Russian regulatory framework has passed a stage of serious modernization in the period under review, temporarily abandoning the use of dispositive principles in favor of the imperative method of legal regulation. To analyze activities of diplomatic missions in the conditions of coronavirus infection, it is recommended to use the term “assistance”. The authors substantiate the necessity to revise the essence of diplomatic protection with regard to diplomats’ working experience during the pandemic.
