El control judicial de la actividad administrativa automatizada

Abstract

In a context of health crisis -still in forcewhere organizations had to exponentially accelerate their digital transformation processes and public administrations, in particular, had to move towards paths traced in the opening of data as consequence of government designs and processes focused on information -which even led to the use of Artifi cial Intelligence techniques for the public sector-, this paper seeks to answer the basic question regarding what should be judicially controlled in the case of automated administrative decision-making activity? Or, with other words, what principles must the Public Administration respect, verifi ed by the Judiciary, when it uses intelligent tools to carry out its functions? Th us, the work off ers -in general termsa series of evaluative tools that the magistrate must have in view to validate, or in his case, invalidate a decision-making action of this type.
